EB-2 NIW is one of the subcategories of second choice employment Green Cards. Awarded to individuals who have exceptional talent in the sciences, arts, or business, or whose employment will greatly benefit the American economy. What sets the EB-2 NIW apart from other EB-2 Green Card categories is that you can apply for a Green Card without a PERM Certificate of Work. This means you can still hold an EB-2 Green Card even if you don’t have a valid job offer from an American employer.
Admission Conditions:
- Applicant must have an advanced degree from the USA or its equivalent.
- Or the applicant; must be able to demonstrate that he or she has above-average talent in fields such as science, art, or business.
In addition to meeting either of these two requirements, the applicant must also meet three criteria listed by USCIS:
- The applicant must demonstrate that their academic background or exceptional abilities are of national importance and of outstanding quality.
- The applicant must have the necessary qualifications to advance their academic or career goals.
- The USA should see a national interest in waiving the standard job offer requirement when applying for a Job-based Green Card.
Family Members:
Spouses and single children under the age of 21 can apply to the applicant. Spouses can enter the United States with E-21 immigration status and children with E-22 immigrant status.
